<p style="text-align: justify; margin-left: 0px;"><b>II –</b> incorporação de superávit e/ou financeiro disponível do exercício anterior, efetivamente apurados em balanço;</p>
<p style="text-align: justify; margin-left: 0px;"><b>III –</b> excesso de arrecadação em bases constantes.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Parágrafo Único - </b>Fica ainda os Poderes Executivo e Legislativo e Entidades da Administração Pública Indireta autorizados a realizar realocação de recursos orçamentários mediante remanejamento, transposição e transferência no mesmo percentual previsto no caput deste artigo.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 8° -</b> O limite autorizado no artigo anterior não será onerado quando o crédito se destinar a:</p>
<p style="text-align: justify; margin-left: 0px;"><b>I –</b> atender ao pagamento de despesas decorrentes de precatórios judiciais, amortização e juros da dívida, mediante utilização de recursos provenientes de anulação de dotações;</p>
<p style="text-align: justify; margin-left: 0px;"><b>II –</b> atender insuficiências de outras despesas de custeio e de capital consignadas em Programas de Trabalho das funções Saúde, Assistência Social, e em Programas de Trabalho relacionados à Manutenção e Desenvolvimento do Ensino, mediante o cancelamento de dotações das respectivas funções;</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 9° -</b> Fica autorizado e não será computado para efeito do disposto no Art. 7º e seus incisos:</p>
<p style="text-align: justify; margin-left: 0px;"><b>I -</b> Os Créditos Especiais Suplementares abertos com recurso do excesso do excesso de arrecadação, na forma do Art. 43, § 1°, Inciso II da Lei Federal nº. 4.320/64;</p>
<p style="text-align: justify; margin-left: 0px;"><b>II –</b> Os créditos adicionais abertos para sustentar despesas de convênios com Órgãos Federais e Estaduais não previstos na receita orçamentária.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 10 -</b> O Executivo Municipal, fundamentado na Constituição Federal, na Constituição do Estado do Paraná, na Lei Federal nº. 4.320 de 17/03/64, a Lei Complementar nº. 101/2000, e na Lei Orgânica do Município, fica autorizado à:</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>I – </b>fazer a contenção da despesa, na forma do disposto no Artigo 9º da Lei Complementar nº. 101/2000, promovendo a limitação da despesa de investimentos e/ou custeio;</p>
<p style="text-align: justify; margin-left: 0px;"><b>II -</b> utilizar o valor de R$ 154.317,67 (cento e cinquenta e quatro mil trezentos e dezessete reais e sessenta e sete centavos), de Reserva de Contingência visando o atendimento de passivos contingentes e outros riscos fiscais imprevistos, bem como para servir de recurso para créditos orçamentários adicionais;</p>
<p style="text-align: justify; margin-left: 0px;"><b>III -</b> utilizar o controle da despesa por custo de Serviço ou Obra que não se encontrem especificado em projetos e atividades.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b><u>TÍTULO III</u></b></p>
<p style="text-align: justify; margin-left: 0px;"><b><u>DAS DISPOSIÇÕES GERAIS</u></b></p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 11 - </b>Estão plenamente assegurados os recursos para investimentos em fase de execução, em conformidade com o disposto na Lei de Diretrizes Orçamentárias para o exercício de 2023.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 12 -</b> As dotações para pagamento de pessoal e encargos sociais da administração direta, bem como as referentes a servidores colocados à disposição de outros órgãos e entidades, serão movimentadas pelos setores competentes da Administração Geral.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;">Art. 13 - Fica autorizado o poder executivo municipal, respeitadas as limitações legais no que concerne à realização de despesas com pessoal:</p>
<p style="text-align: justify; margin-left: 0px;">I - Conceder pagamentos de gratificações, adicionais e/ou horas extras de acordo com o estabelecido no Estatuto dos Servidores Públicos Municipais;</p>
<p style="text-align: justify; margin-left: 0px;">II - Proceder à criação de novos cargos e/ou abrir novas vagas de servidores na medida em que forem surgindo as necessidades;</p>
<p style="text-align: justify; margin-left: 0px;">III - Proceder à nomeação de servidores na medida das necessidades e no limite das vagas criadas pela Legislação própria;</p>
<p style="text-align: justify; margin-left: 0px;">IV - Proceder à concessão de reajustes, revisão geral anual, progressão funcional, promoções e/ou aumentos de vencimentos nos limites das disponibilidades financeiras do Município e de acordo com as normas legais específicas.</p>
<p style="text-align: justify; margin-left: 0px;">V - Proceder a readequação ou criação de plano de cargos e salários dos servidores públicos municipais.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 14</b> - Para corrigir distorções ou defasagens salariais os vencimentos e vantagens fixas dos servidores públicos municipais deverão ser reajustados anualmente em conformidade com as legislações vigentes.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 15 - </b>A utilização de dotação com origem de recursos de convênios e de operações de crédito fica condicionada à celebração dos instrumentos.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 16 -</b> Ficam aprovados os Orçamentos que estimam as Receitas e Fixam as Despesas da Administração Indireta:</p>
<p style="text-align: justify; margin-left: 0px;"><b>I –</b> Serviço Autônomo Municipal de Água e Esgoto - SAMAE, com Receita Estimada em R$ 2.900.000,00 (dois milhões e novecentos mil reais), e Despesa Fixada em R$ 2.900.000,00 (dois milhões e novecentos mil reais).</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 16-A. </b>Fixa o Orçamento Impositivo em emendas individuais oriunda do Poder Legislativo Municipal ao Projeto de Lei Orçamentária Anual (LOA) que serão aprovadas no limite percentual de 1,2% (um vírgula dois por cento) da Receita Corrente Liquida encaminhada pelo Poder Executivo Municipal, sendo que a metade deste percentual (0,6% - zero vírgula seis por cento) será exclusivamente destinada a ações e serviços públicos de saúde, nos ditames Art. 130-A da Lei Orgânica Municipal, conforme anexo I.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Parágrafo único -</b> Estima-se que o montante referente ao percentual de 1,2% (um vírgula dois por cento) da Receita Corrente Liquida destinado ao Orçamento Impositivo será de aproximadamente R$ 408.385,26 (quatocentos e oito mil, trezentos e oitenta e cinco reais e vinte e seis centavos).</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 16-B.</b> As Emendas individuais impositivas do Poder Legislativo deverão ser executadas conforme indicação contida no anexo I da presente emenda.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 16-C</b>. Deverá o Poder Executivo encaminhar as alterações no Plano Plurianual e Lei Orçamentária Anual a fim de adequar os referidos instrumentos à presente emenda impositiva.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b><u>TÍTULO IV</u></b></p>
<p style="text-align: justify; margin-left: 0px;"><b><u>DAS DISPOSIÇÕES FINAIS</u></b></p>
<p style="text-align: justify; margin-left: 0px;"><b><u>CAPÍTULO ÚNICO</u></b></p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 17 –</b> Fica o Poder Executivo autorizado a contratar e oferecer garantias a empréstimos voltados para o saneamento e habitação em áreas de baixa renda.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 18 – </b>O Poder Executivo, poderá adotar parâmetros para utilização das dotações, de forma a compatibilizar as despesas à efetiva realização das receitas, para garantir as metas.</p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 19 – </b>Fica o Poder Executivo autorizado a realizar operações de crédito com Instituições Financeiras, firmando convênios ou similares com a SEDU-Secretaria de Estado de Desenvolvimento Urbano ou Órgão competente para tal, para desenvolver metas ligadas ao PPU-Programa Paraná Urbano, FDU-Fundo de Desenvolvimento Urbano e outros programas da mesma natureza, obedecendo aos limites de capacidade de endividamento do Município consoantes normas do Banco central, até o limite de 10% (dez por cento) do Orçamento Geral do Município.</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 20 –</b> Integrarão e acompanharão esta Lei:</p>
<p style="text-align: justify; margin-left: 0px;">Sumário geral da receita por fontes e da despesa por funções do Governo;</p>
<p style="text-align: justify; margin-left: 0px;">Quadro demonstrativo da Receita e Despesa segundo as Categorias Econômicas;</p>
<p style="text-align: justify; margin-left: 0px;">Quadro discriminativo da receita por fontes;</p>
<p style="text-align: justify; margin-left: 0px;">Quadro das dotações por órgãos;</p>
<p style="text-align: justify; margin-left: 0px;">Quadro demonstrativo da despesa;</p>
<p style="text-align: justify; margin-left: 0px;">Quadro demonstrativo do programa anual de trabalho do Governo;</p>
<p style="text-align: justify; margin-left: 0px;"> </p>
<p style="text-align: justify; margin-left: 0px;"><b>Art. 21 –</b> Esta Lei entra em vigor na data de sua publicação, revogadas as disposições em contrário, surtindo seus efeitos a partir de 1° de janeiro de 2023.</p>
